Notificación de Estado Condicional
Si al momento de ser admitido a los Estados Unidos usted no habrá celebrado el segundo aniversario de su matrimonio, lo cual es la base de su estado como residente, usted está sujeto a las provisiones de la Sección 216 del Acta de Inmigración y Nacionalidad. Bajo esta provisión, a usted se le otorgará residencia permanente condicional por un oficial de Aduanas y Protección Fronteriza de los Estados Unidos del Departamento de Seguridad Nacional al momento de ser admitido a los Estados Unidos. Como resultado, usted y su esposo(a) deberán someter una petición conjunta al Servicio de Ciudadanía e Inmigración de los Estados Unidos del Departamento de Seguridad Nacional para que su estado condicional sea removido. La petición deberá ser sometida dentro del período de los 90 días antes de cumplirse el segundo aniversario de haberle sido otorgado el estado de residencia condicional. Si la petición solicitando la eliminación de la base condicional de su estado no es sometida durante ese período, su condición de residente permanente condicional será terminada automáticamente y usted estará sujeto a ser deportado de los Estados Unidos.
Notice of Conditional Status
If, at the time of admission to the United States you will not have celebrated the second anniversary of your marriage, which is the basis of your immigrant status, you are subject to the provisions of Section 216 of the Immigration and Nationality Act. Under the provision, you will be granted conditional permanent residence by an officer of U.S. Customs and Border Protection of the Department of Homeland Security at the time of your admission to the United States. As a result, you and your spouse must file a joint petition with U.S. Citizenship and Immigration Services of the Department of Homeland Security to have the conditional status removed. The petition must be filed within the 90-day period immediately preceding the second anniversary of the date you were granted conditional permanent resident status. If a petition to remove the conditional basis of your status is not filed within this period, your conditional permanent residence status will be terminated automatically and you will be subject to deportation from the United States.
